On 08/09/2004 Ampersand withdrew the two planning applications which were to be the subject of a Public Enquiry. The Public Enquiry, therefore, was cancelled and the need for our supporters to lobby John Prescott was removed.

We believe that this is a temporary situation, however, and feel sure that the developer will soon submit an alternative planning application with a variation on the desired Beach scheme or a 'new' Sea Wall proposal. At that point we will all need to campaign to ensure that the proposed new build is subject to an Environmental Impact Assessment.
EIA Directive 85/337/EEC as amended by Directive 97/11/EC. The Directive requires Member States to "adopt all measures necessary to ensure that, before consent is given, projects likely to have significant effect on the environment by virtue inter alia, of their nature, size or location are made subject to an assessment with regard to their effects".
